2. Applicability

By visiting our website or placing an order, you agree to these Terms of Service. If you do not agree with these Terms, please do not use our website or place an order.

These Terms do not affect any mandatory rights you have as a consumer under applicable law.

3. Our Products

We sell homemade cookies that are prepared in small batches. Because our cookies are handmade, minor variations in appearance, size, shape, colour and decoration may occur. These natural variations do not affect your statutory consumer rights.

We make reasonable efforts to ensure that product descriptions and images accurately represent our cookies. However, photographs are illustrative and the actual product may differ slightly.

4. Product Availability

Our cookies may be available in limited quantities and during specific ordering periods. Products may sell out, and we reserve the right to update product availability on our website.

If we cannot fulfil an order after payment has been made, we will contact you and arrange an appropriate refund.

5. Product Information, Ingredients and Allergens

Product descriptions include relevant information about ingredients and allergens. Please read this information carefully before ordering, particularly if you have a food allergy or intolerance.

Although we take care when preparing our products, our cookies are made in a home kitchen where different ingredients are handled. We cannot guarantee the complete absence of unintended traces of allergens.

If you have questions about ingredients or allergens, please contact us before placing your order.

6. Placing an Order

You can place an order through our online store by selecting the available products, adding them to your cart and completing the checkout process.

Please check your order details, delivery address and contact information carefully before submitting your order.

7. Order Confirmation and Acceptance

After placing an order, you should receive an order confirmation by email. This confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it if there is an error or a genuine reason we cannot fulfil it.

If we need to cancel an order, we will notify you and refund any payment received for the cancelled order.

8. Prices and VAT

All prices are displayed in euros (€) unless stated otherwise. Any applicable VAT and additional charges will be shown during checkout before you complete your purchase.

Shipping costs are displayed separately where applicable. The final amount payable will be shown before you submit your order.

9. Payment

Payment must be completed using one of the payment methods available at checkout. Your order will be processed in accordance with our ordering and preparation schedule once the order has been successfully placed.

We do not store full payment card details ourselves when payments are processed by third-party payment providers.

10. Freshly Baked Products

Our cookies are prepared according to our production schedule and may be baked specifically for customer orders.

Please follow any storage instructions provided on the product packaging. Product freshness and shelf life depend on proper storage and handling after delivery.

11. Shipping and Delivery

We currently ship orders using DHL or another delivery service indicated at checkout.

Delivery estimates are provided for guidance and are not guaranteed unless expressly stated otherwise. Delivery times may be affected by circumstances outside our control.

We aim to dispatch orders according to the schedule communicated on our website. If a significant delay occurs, we will make reasonable efforts to inform you.

Our responsibility for delivery and any remedies available to you are subject to applicable consumer law.

12. Delivery Address

You are responsible for providing a complete and accurate delivery address at checkout.

If an order cannot be delivered because the address supplied was incorrect or incomplete, please contact us. Any additional delivery arrangements or costs will be handled in accordance with applicable law and the circumstances of the order.

13. Missed or Failed Delivery

If you are not available to receive your order, the carrier may follow its standard procedures, such as leaving delivery instructions or arranging another delivery attempt.

If an order is returned to us or cannot be delivered, please contact us so that we can discuss the available options. Any additional costs or responsibility will be assessed fairly and in accordance with applicable law.

Nothing in this section removes your statutory consumer rights.

14. Right of Withdrawal

Under Dutch and EU consumer law, consumers generally have a right to withdraw from certain online purchases within the applicable withdrawal period.

However, the statutory right of withdrawal does not apply to certain goods, including goods that perish quickly or have a limited shelf life, where the relevant legal exception applies. Freshly baked cookies may fall within this exception depending on the circumstances.

Where a statutory exception applies, we do not accept change-of-mind cancellations or returns under the right of withdrawal for those products.

This does not affect your rights if products are incorrect, damaged, defective or otherwise fail to conform to the purchase agreement.

15. Returns and Refunds

Because our cookies are food products and may be perishable, we generally do not accept returns for change of mind where the statutory withdrawal exception applies.

If you receive an incorrect, damaged or defective order, please contact us as soon as reasonably possible at info@hangrycrumbs.com and include your order number and relevant details. Photographs may help us assess the issue.

We will review the situation and, where appropriate, offer a replacement, refund or another remedy in accordance with applicable law.

Any request to report an issue promptly is intended to help us investigate; it does not limit any mandatory rights you may have under consumer law.

For further details, please see our Return and Refund Policy on our website.

16. Incorrect, Damaged or Defective Orders

Please inspect your order after delivery and contact us if something is wrong.

If your order is incorrect, damaged during delivery or does not meet the requirements of the purchase agreement, we will work with you to resolve the issue in accordance with applicable law.

Please include your order number and a clear description of the issue when contacting us.

17. Statutory Consumer Guarantee

Our products must meet the requirements that consumers are legally entitled to expect under Dutch consumer law.

Nothing in these Terms excludes or limits your statutory rights relating to non-conforming goods, defects or other consumer protections that cannot legally be excluded.

18. Complaints

If you have a question, concern or complaint about an order, please contact us at info@hangrycrumbs.com.

We will make reasonable efforts to respond and work towards a fair solution.

If we cannot resolve a dispute directly, you may have access to the dispute-resolution options available under applicable consumer law.

19. Customer Accounts

If our website allows you to create a customer account, you are responsible for keeping your login details confidential and for activity carried out through your account.

Please notify us if you suspect unauthorised access to your account. We may suspend or restrict an account where reasonably necessary for security, fraud prevention or compliance with the law.

20. Acceptable Use of Our Website

You agree not to use our website unlawfully, interfere with its operation, attempt to gain unauthorised access to its systems or submit false or fraudulent orders.

We may take reasonable steps to protect our website, customers and business against misuse.

21. Intellectual Property

Unless otherwise stated, the content on our website, including our brand name, logo, product descriptions, photographs, graphics and designs, belongs to Hangry Crumbs or is used with permission.

You may not reproduce, distribute, modify or commercially use this content without our prior written permission, except where permitted by law.

22. Reviews and Customer Content

If you submit a review, photograph or other content to us, you are responsible for ensuring that you have the right to share it and that it does not violate another person's rights or applicable law.

By submitting content, you grant us permission to use it for the purpose for which it was submitted. Any broader use, such as promotional use, will require an appropriate legal basis or permission where required.

We reserve the right to moderate or remove content where reasonably necessary, subject to applicable law.

23. Website Availability and Accuracy

We aim to keep our website available and its information accurate and up to date. However, we cannot guarantee uninterrupted access or that the website will always be free of errors.

We may update, change or temporarily suspend parts of the website for maintenance, security or operational reasons.

Nothing in this section limits any rights you have under applicable law.

24. Third-Party Services and Links

Our website may use third-party services, including payment processors, Shopify and delivery providers, or contain links to external websites.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for the independent content or practices of external websites, but this does not affect any obligations we have under your purchase agreement or applicable law.

25. Privacy

We process personal data in accordance with our Privacy Policy and applicable data-protection laws, including the General Data Protection Regulation (GDPR).

Please read our Privacy Policy to understand how we collect, use and protect your personal data.

26. Cookies

Our website uses cookies and similar technologies. Some are necessary for the website to function, while others may be used for analytics, preferences or marketing.

Where required by law, we will request your consent before placing non-essential cookies. Further information is available in our Cookie Policy and cookie settings.

27. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, these Terms do not limit our liability for fraud, intentional misconduct, gross negligence where liability cannot legally be excluded, or any mandatory consumer rights.

To the extent permitted by law, we are not responsible for losses arising from circumstances outside our reasonable control or from a customer's failure to follow reasonable product storage instructions. This does not affect our statutory obligations regarding product safety or conformity.

28. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, transport disruptions, interruptions to essential services, or other unforeseen circumstances.

Where such an event affects an order, we will make reasonable efforts to inform affected customers and explain the available options. Your mandatory statutory rights remain unaffected.

29. Fraud and Abuse

We reserve the right to investigate suspected fraudulent activity or misuse of our website and to take proportionate action where legally permitted.

If an order cannot lawfully or reasonably be fulfilled because of suspected fraud or another legitimate reason, we may cancel it and refund any payment received for the cancelled order, where appropriate.

30. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products or legal obligations.

The latest version will be published on our website with its updated date. Changes will not retroactively remove rights you already have under applicable law or alter an existing order in a way that is not legally permitted.

31. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

32. Applicable Law

These Terms are governed by the laws of the Netherlands.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections afforded to you under applicable law.

33. Disputes

If you have a dispute with us, please contact us first so that we can try to resolve it directly.

Where a dispute cannot be resolved amicably, it may be brought before the competent court in accordance with applicable law and the mandatory rights of consumers.
